365 Buyback Guarantee Terms & Conditions
We are confident that your new HVAC system will provide the heating and cooling performance you expect. We believe you should not be stuck with a system that we cannot make perform properly.
That’s why we back qualifying installations with our 365 Buyback Guarantee:
If we are unable to correct a qualifying performance issue after reasonable repair and adjustment attempts, we will remove the system and refund the eligible amount of your original investment.
How the Guarantee Works
1. Contact Us
If you believe your new system is not performing as promised, contact us within 365 days of the original installation date. We will schedule a visit to evaluate the system and determine the cause of the reported problem.
2. We Make It Right
If the issue is related to our equipment selection, installation, workmanship, or another condition covered by this guarantee, we will make reasonable repairs, adjustments, or corrections at no additional charge. This may include equipment adjustments, control adjustments, repairs, replacement of defective components, or other corrective work reasonably necessary to bring the system into compliance with the applicable performance specifications.
3. We Get a Reasonable Opportunity to Correct the Problem
The buyback portion of this guarantee is intended to be a last-resort remedy, not the first remedy. Before a buyback can be requested, we must be given a reasonable opportunity to diagnose and correct the qualifying issue. This may include involving the equipment manufacturer or other resources to test, evaluate, and repair the system.
4. The Buyback
If, after reasonable corrective efforts have been exhausted, the system continues to fail to meet the applicable performance requirements, you may request the buyback remedy. Upon approval of the claim, we will:
- Remove the HVAC equipment we installed;
- Disconnect the system in a safe and professional manner;
- Refund the eligible amount paid for the qualifying HVAC installation, subject to the terms and exclusions below.
What Qualifies
This guarantee applies to objectively verifiable performance problems attributable to the HVAC system, our installation, or our equipment selection. Examples may include:
- The system cannot maintain the temperature or performance requirements documented in your installation agreement under applicable design conditions.
- A material installation or workmanship issue prevents the system from performing as represented.
- The equipment or installation has a recurring qualifying failure that we are unable to correct.
What Does Not Qualify
The 365 Buyback Guarantee is not a general right to return an HVAC system or cancel a completed installation because you have changed your mind. The following do not, by themselves, qualify for a buyback:
- Buyer’s remorse or a change of mind;
- Deciding that you would prefer a different brand, model, equipment configuration, or contractor;
- Finding another contractor offering a lower price after the installation;
- Dissatisfaction unrelated to the system’s objective performance;
- Changes in your heating or cooling preferences after installation;
- Operating sounds, temperatures, or cycling that are within manufacturer specifications;
- Performance expectations that were not included in the written installation agreement;
- Conditions caused by existing ductwork, airflow, insulation, windows, doors, building envelope, electrical service, structural conditions, or other portions of the home that were outside our contracted scope of work;
- Conditions created or materially changed by remodeling, construction, landscaping, additions, or other modifications after installation;
- Damage, misuse, neglect, abuse, unauthorized repairs, alterations, or modifications performed by someone other than us;
- Failure to operate or maintain the system in accordance with manufacturer requirements;
- Problems caused by power interruptions, utility conditions, acts of nature, or other circumstances beyond our reasonable control;
- Differences in temperature between rooms or areas of the home that were not included within the system’s documented design or scope;
- Temporary conditions or performance limitations outside the design conditions for which the system was selected.
Existing Home Conditions
An HVAC system operates as part of the home as a whole. Accordingly, this guarantee does not make us responsible for conditions outside the equipment and installation scope described in your agreement. For example, an existing duct system, inadequate insulation, excessive air leakage, windows, doors, building orientation, solar gain, electrical limitations, or other pre-existing conditions may affect comfort even when the HVAC equipment itself is operating properly. If such a condition is identified, we will explain the issue to you and, where practical, provide recommendations for improving it.
Customer Responsibilities
To remain eligible for this guarantee, you agree to:
- Operate the system in accordance with the manufacturer’s instructions;
- Maintain reasonable access to the equipment;
Promptly notify us of material performance problems; - Allow us reasonable access to inspect, test, repair, adjust, and service the system;
- Not permit another contractor or unauthorized person to maintain, modify or repair the system without our prior written authorization;
- Complete any maintenance specifically identified as a condition of your installation agreement.
What We Refund
If a buyback is approved, the refund is limited to the eligible amount actually paid for the qualifying HVAC equipment and installation covered by this guarantee. Unless specifically stated otherwise in your installation agreement, the refund does not include:
- Financing charges or interest;
- Permit fees or governmental charges;
- Third-party products or services;
- Repairs or improvements outside our original scope of work;
- Work performed by another contractor;
- Consequential, incidental, or indirect costs;
- Costs associated with remodeling or restoration unrelated to our removal of the system.
Upon completion of the approved buyback, ownership of the equipment being removed will revert to us.
One-Year Time Limit
This guarantee applies to qualifying installations for 365 days from the original installation date. A performance concern must be reported to us within that period. If a qualifying issue is reported within the 365-day period, we will have a reasonable opportunity to diagnose and correct the issue even if the diagnostic or corrective process extends beyond the original 365-day period.

What we do promise is that when you purchase a qualifying HVAC system from us, we will stand behind its performance and work with you to make it right.
